Term and Conditions
- 1. The Relief Agency shall pay the Pharmacist or their incorporation hereupon the assignment completed and invoiced.The price for each assignment will be determined by Relief Agency and the Pharmacist together.
- 2. All Payments paid by Relief Agency shall be made without statutory deductions in respect of Income tax, Canada Pension Plan, Employment Insurance, Worker’s Compensation, and the Ontario employer’s Health tax. The Pharmacist shall remit payment of such monies to the appropriate government bodies and it is the sole responsibility of the Pharmacist to do so.
- 3. In the event that Relief Agency were found liable to remit monies on behalf of the Pharmacist for Income tax, Canada Pension Plan, Employment Insurance, Worker’s compensation, or the Ontario employers’ health tax, the Pharmacist agrees to indemnify the Relief Agency for any obligation, including penalties and interest, which Relief Agency may be required to pay on its behalf and on behalf of the Pharmacist.
- 4. The relationship between you and the Relief Agency is that of an Independent Contractor. You are not and will not be considered to be one of our employees and assume full responsibility and liability in providing the service to the client assigned. The Pharmacist will hold harmless and indemnify the Relief Agency for any claims for loss or damage due to an act, error, omission or negligence on part of the Pharmacist.
- 5. You must adhere to all store Standards, Policies, Regulations, Patient and Business Confidentiality, and Ethical behavior.
- 6. This agreement will be effective within the laws of whatever Province or Territory it was signed in.
- 7. All representations, warranties, covenants, and limitations of liability in this contract shall remain in force after the termination of this Agreement.
- 8. In completing the assignment, the Pharmacist agrees to provide his/her own equipment, tools, and other materials at his/her own expense, where required.
- 9. The Pharmacist, at his/her sole cost and expense, shall maintain Professional Liability Insurance which is valid for any location where he/she works with limits of not less than $2,000,000 per occurrence and which is acceptable to Ontario College of Pharmacists, including Malpractice insurance and produce a proof of the same when asked for.
- 10. The Pharmacist will not work at the client’s location either as employee or independent contractor directly for a period of 365 days from the last shift worked at that location, unless it is mutually agreed upon in writing with the agency.

- 12. As an Independent Contractor, please note that Pick-A-Shift is a platform for you to find and book temporary employment opportunities that are typically short-term and often short-notice emergency relief shifts.
